These Terms and Conditions govern your use of gutierrezlumanaglaw.com and related booking or payment flows operated by Gutierrez & Lumanag Law and Notary (the “Firm”), including consultations paid through PayMongo.

By using this website, submitting a booking request, or paying a consultation fee, you agree to these Terms. If you do not agree, please do not use the site or online booking/payment features.

1. General information only

Content on this website (including practice-area descriptions, articles, and examples) is for general informational purposes. It is not legal advice for your specific situation and should not be relied on as a substitute for a consultation with counsel.

Laws and procedures change. We may update site content without notice. Always confirm current requirements with the Firm or another qualified lawyer.

2. No attorney-client relationship by website use alone

Browsing this site, filling out a form, messaging us, booking a consultation, or paying a consultation fee does not by itself create an attorney-client relationship for full representation of a case or matter.

A consultation is a limited engagement for advice and assessment for the scheduled session. Full representation (filing, court appearance, continuous handling of a matter, and the like) begins only when both parties agree—typically through a written engagement agreement or as otherwise required under applicable professional rules—and after conflict checks and acceptance by the Firm.

Do not send confidential or privileged information through public forms before we confirm that we can assist you and that no conflict exists.

3. Consultation bookings and fees

You may request a walk-in (office) or online consultation through the website booking flow. Fees shown at booking for the selected visit type are the fees that apply to that request unless the Firm confirms a different amount in writing.

• Online consultations generally require successful payment of the consultation fee before calendar scheduling is unlocked.
• Walk-in consultations may be paid at the office on the appointment date or prepaid online when that option is offered.
• Consultation fees reserve professional time for advice and case assessment. They are not a product purchase and are not a guarantee of case outcome or that the Firm will accept full representation.
• The Firm may decline, reschedule, or cancel a booking for conflict, capacity, incomplete information, or professional reasons. If we cancel and no alternative is agreed, unused fees are addressed under the Return and Refund Policy.

You agree to provide accurate name, contact details, and booking information. Misleading or incomplete information may result in cancellation without obligation to hold the slot.

4. Online payments (PayMongo)

Online payments are processed by PayMongo and its payment partners (which may include cards, e-wallets, QR Ph, and other methods shown at checkout). The Firm does not store full card numbers on this website.

• By completing checkout, you authorize the charge for the stated amount and agree that payment confirmation may unlock or confirm your booking.
• You are responsible for ensuring that the payment method used is yours or that you are authorized to use it.
• Failed, declined, or incomplete payments do not confirm a prepaid booking. If you were charged in error or twice, contact us promptly with your PayMongo / transaction reference.
• Refunds, returns of fees, and payment disputes are governed by our Return and Refund Policy and Dispute Resolution Policy.

5. Acceptable use

You agree not to misuse the website or booking systems, including by attempting to disrupt services, scrape content for unlawful purposes, submit spam or abusive communications, or impersonate another person. We may restrict access where we reasonably believe these Terms have been violated.

6. Intellectual property

Website text, branding, layout, and materials are owned by the Firm or its licensors. You may view and print pages for personal, non-commercial reference. You may not copy, republish, or commercially exploit site content without prior written consent, except as allowed by law (e.g., fair use / fair dealing where applicable).

7. No guarantee of results

Past results, anonymized examples, or descriptions of similar matters do not guarantee any particular outcome. Every case depends on its facts, evidence, procedure, and applicable law.

8. Limitation of liability (website)

To the fullest extent permitted by Philippine law, the Firm is not liable for indirect, incidental, or consequential damages arising from use of this website or from reliance on general information published here. Nothing in these Terms limits liability that cannot be limited by law, or professional duties that apply once a lawyer-client relationship is properly formed.

Third-party services (including PayMongo checkout and calendar scheduling tools) are subject to those providers’ own terms. Interruptions or errors on those platforms are outside the Firm’s full control; we will reasonably assist in resolving booking or payment issues that affect your consultation with us.

9. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Subject to our Dispute Resolution Policy and mandatory consumer or professional rules, disputes relating to website use or consultation fees may be brought in the proper courts of Davao City, Philippines, unless another venue is required by law.

10. Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the website or booking/payment features after updates constitutes acceptance of the revised Terms for future use.
