Gutierrez & Lumanag Law and Notary (the “Firm”) respects your privacy. This Privacy Policy explains what personal information we collect through our website, booking forms, communications, and online payments, and how we use and protect it.

We process personal data in line with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), its IRR, and applicable professional confidentiality rules once a lawyer-client relationship is properly formed.

1. Information we collect

Depending on how you interact with us, we may collect:

• Identity & contact — name, email address, phone number, and similar details you provide.
• Inquiry & booking details — nature of your concern (at a high level), preferred visit type (walk-in or online), preferred schedule notes, and booking references (e.g., walk-in or matter codes).
• Payment-related data — amount, currency, payment status, PayMongo / transaction reference IDs, billing name shown at checkout, and confirmation that a fee was paid. We do not collect or store full card numbers or e-wallet PINs on our website.
• Technical data — approximate device/browser information and analytics events if you consent to or do not opt out of analytics tools we use (see Cookies below).
• Communications — messages you send by email, WhatsApp, phone, or forms.

Please avoid sending highly sensitive case documents through public website forms before we confirm engagement and conflict clearance. Prefer secure channels we designate after intake.

2. How we use information

We use personal information to:

• Respond to inquiries and schedule consultations;
• Create and manage booking records in our practice systems;
• Process, reconcile, and acknowledge consultation payments;
• Issue receipts or payment acknowledgments and follow up on failed or duplicate payments;
• Perform conflict checks and decide whether we can assist;
• Provide legal services when formally engaged;
• Improve website reliability and security, and comply with legal or regulatory obligations;
• Contact you about your appointment, payment, or related firm communications you reasonably expect.

We do not sell your personal information.

3. Online payments and PayMongo

When you pay online, checkout is handled by PayMongo and its payment partners. Card, bank, or e-wallet credentials entered on PayMongo’s pages are processed under PayMongo’s privacy and security practices.

We receive limited confirmation data needed to record your payment and unlock or confirm your booking (for example: paid amount, status, timestamps, and reference IDs). For PayMongo’s own privacy notices, please refer to PayMongo’s published policies on their website.

4. When we share information

We may share personal data only as needed with:

• Service providers who help us operate bookings, calendars, email, hosting, or payments (including PayMongo), under appropriate confidentiality and data-processing expectations;
• Professional colleagues within the Firm who need the information to assist you;
• Authorities or courts when required by law, regulation, or valid legal process;
• Other parties with your consent, or as needed to protect the Firm’s rights, safety, or property in a manner consistent with professional rules.

Once you are a client under a formal engagement, disclosures of confidential information are further limited by the Code of Professional Responsibility and Accountability and related rules.

5. Retention

We keep personal data only as long as needed for the purposes above, including booking and payment records, accounting and tax requirements, dispute resolution, and professional file-retention practices. When data is no longer needed, we delete or securely dispose of it, or anonymize it where appropriate.

6. Security

We apply reasonable administrative and technical measures to protect personal data against unauthorized access, loss, or misuse. No method of transmission over the internet is completely secure; please use strong unique passwords for any portals we provide and notify us promptly of suspected unauthorized access related to your booking or payments.

7. Your privacy rights

Subject to the Data Privacy Act and applicable exceptions (including professional privilege and legal holds), you may request to:

• Access personal data we hold about you;
• Correct inaccurate or incomplete data;
• Object to or withdraw consent for certain processing where consent is the basis;
• Request erasure or blocking where allowed by law;
• File a complaint with the National Privacy Commission if you believe your data privacy rights were violated.

8. Cookies and analytics

Our website may use cookies or similar technologies for basic functionality and, where configured, analytics (such as Google Analytics) to understand aggregate traffic. You can control cookies through your browser settings. Disabling cookies may affect some site features.

9. Children

Our website and online booking are directed to adults seeking legal services. We do not knowingly collect personal data from children online for marketing. If you believe a child provided data inappropriately, contact us so we can delete it where required.

We may update this Privacy Policy from time to time. The “Last updated” date at the top will change when we do. Material changes will be reflected on this page; continued use of the website after updates means you acknowledge the revised policy for future interactions.
